1 All the GWD's services will be used for lawful purposes only  
2 Transmission, protection or presentation of information, dated, or material in violation with Canadian laws or laws of the Province of Quebec are forbidden. This includes, but is not limited to: Laws on copyrights ( A ), contents that can be consider threatening ( B ), obscene or a content protected by the commercial secret or the other recording ® or being able to damage the national defense. A) Sending of images digitized for which the sender does not possess rights.    ( B ) comment Threatens or harassment, racism or resentment.
3 Pornography and all the contents of the same nature are forbidden on all our servers. This included the  links of any categories which bring the guest to another site which would present a content of sexual nature. Childish pornography.
4 The promotion of any illegal activity ( C ), or the presentation of contents which could be slandering on GWD's services, for one of his/her) partners or for another server on internet are rigorously forbidden. C) Exchange of pirated software packages.
5 Sale or promotion of electronic lists of addresses are also forbidden. Bulk email.

GWD will not be responsible for any damages your business may suffer. GWD makes no warranties of any kind, expressed or implied for services we provide. GWD disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, and any and all service interruptions caused by GWD and its employees. GWD reserves the right to change or update policies without notice  If any terms or conditions are failed to be followed it may result in account deactivation.

7 GWD will be the only one authorized to determine what establishes constitutes) a violation of his politics policies) of operation These activities will have as consequence the deactivation of your account.  
8 CGI Scripts
Each account comes with its own cgi-bin. You are free to use any CGI scripts you wish, however we reserve the right to disable any CGI script that effects normal server operation without prior warning.		  
9 Chat Rooms
We do not allow clients to install their own chat rooms. These tend to be large system hogs and we cannot allow it as an account option. We do provide a choice of Java chat rooms for a small extra charge that will more than fill your needs and run without hindering the performance of the machine for others.		  
10 Background Running Programs
Background daemons in general are prohibited, we will consider requests on a one on one basis. If allowed extra charges will be assessed based on resources on system maintenance needed.		  
11 IRC
We currently do not allow IRC or IRC bots to be operated on our servers.

Commercial Advertising - Email:
Our servers may not be the source, intermediary, or destination address involved in the transmission of spam, flames, or mail bombs. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. Advertising sites on other servers which in turn contain links to a domain on our servers is prohibited. We consider spam any mass unsolicited message in the mediums of Newsgroups and Email. If you are found to have spammed, then we will immediately, without warning, disable your domain. In addition, we will impose a $100 penalty for each spam policy violation. We reserve the right to refuse or cancel service to known spammers. Lastly, we reserve the right to determine what violates this policy.

As such, any violation will result in immediate deactivation of services without refund.

 We suggest to take 2 minutes to visit CAUCE and get protection agains this type of e-mail polution.

Indemnification:
Customer agrees that it shall defend, indemnify, save and hold GWD harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against GWD, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless GWD against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with GWD server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party and (3) copyright infringement.

Traffic Guidelines
Due to the unique resource characteristics and traffic patterns associated with certain types of sites, the following are limited to 3 gigs of free traffic:

  • Shareware, sound, video, image and multimedia archives
  • Mirror sites
  • Distribution points
  • Any site whose primary purpose is file distribution.
  
Refusal of service and cancellation  
15 GWD saves himself the right to refuse or to deactivate a service in his/her) discretion and without advance notice. In the case of the cancellation of the account of a customer without explanation, not used services will be repaid    In the case of a violation of the conditions of use no refund repayment) will be made.  
Payment  conditions  
16 Invoicing are made by e-mail every month. For payment conditions , invoices are considered as paid.  
17 Any payment blocked, returned by a financial institution or refused by the customer will entail the automatic suspension of the FTP access of the customer. An e-mail of reminder of demand of payment by GWD, will grant one delay period of 72 hours . On reception of the payment the access FTP will be restored.  If the payment is not made before the end of this period of 72 hours the site will be deactivated.

Expenses of 25$ shall be required to reactivate the site.

  
18 Any change in payment  or cancellation of account must be made by in writing to :
